Terms & Conditions

 

  1. Contract of Hire: The contract of hire is between the main party member (who must be over the age of 18 years) and Hoeside Holiday Apartments and is made in agreement with these terms and conditions.
  2. Party Size: The party size must not exceed the numbers agreed with Hoeside Holiday Apartments with no parties to be held on the premises. Sorry no pets are allowed.
  3. Initial Payment: Bookings will not be confirmed unless the initial deposit of 25% and a damages bond of £100 has been received in full. However, if the booking is made within 6 weeks of the commencement of the holiday/stay the full cost is due immediately.
  4. Balance Payment: Balance of hire will be due 6 weeks before the holiday/stay commencement date. We reserve the right to cancel the holiday/stay where the balance has not been paid 6 weeks before the holiday/stay commencement date.
  5. Booking Cancellation: Cancellations are accepted, the deposit is non-returnable. However, should we not be able to relet the property, the main party member will remain liable for the full balance of the holiday/stay. 
  6. Holiday/stay Insurance, we would advise you to take out insurance for any eventuality that will mean that you will not be able to take your holiday.
  7. Arrival & Departure: The property will be available from 3.00pm on the day of arrival and must be vacated by 10.00am on the day of departure. The property is hired on the understanding that the accommodation is for holiday/stay use only and that no right to remain in the accommodation exists for the guest or anyone in the guest’s party.
  8. Personal Possessions: We do not accept any responsibility for any belongings or personal possessions of any member of the party.
  9. Liability: Hoeside Holiday Apartments will not be liable for any act, neglect, or default on the part of the owner or any other person, nor for any accident, damage, loss or injury, expenses or inconvenience to any person or thing brought on to the property, nor for personal injury or loss of life.
  10. Non availability of the property: If due to reasons beyond the control of Hoeside Holiday Apartments the accommodation is not available, Hoeside Holiday Apartments will refund the guest’s all monies which have been paid over. Hoeside Holiday Apartments will be under no further liability towards you.
  11. Responsibilities: Furnishings, cutlery, electrical appliances etc. must not be taken from the property under any circumstances. No adjustments or alterations should be made to any of the electrical fuses or central heating system. A £100 refundable damages bond will be required prior to receiving the property keys. This is refundable after the property has been vacated and checked. All damage and breakages are the responsibility of the main hirer and must be paid for on demand. The main hirer is responsible for the property and is expected to take care of it. The property and its contents must be left clean and tidy at the end of the holiday/stay, details of waste disposal and laundry and can be found on display in the property. If the property is not left in an acceptable condition an additional cleaning charge may be deducted from the damages bond at the discretion of the Owner. Please note if damage is more than excess this will be charged accordingly.
  12. If at any time, any member of the party behaves in such a manner considered to be prejudicial to the property or causes annoyance to any of the neighbouring properties Hoeside Holiday Apartments has the right to repossess the property and terminate the letting agreement. Neighbours are not to be disturbed by noisy outside parties and loud playing of audio equipment or musical instruments etc.
  13. Electricity & Central Heating: The apartments are all electric and the central heating and power is paid for by electric meters
  14. Linen: bed linen, duvet covers, towels and tea towels will be provided.
  15. Faults: All faults or breakages occurring in the property must be reported to Hoeside Holiday Apartments as soon as possible. No attempts should be made to repair or replace any items.

This website (www.hoeside.co.uk) (the “Site”) is maintained by Hoeside Holiday Apartments (“we”, “us”). Access to and use of this Site is subject always to the following terms and conditions. By using this Site you indicate that you accept these terms and conditions and you agree to abide by them. Hoeside Holiday Apartments reserves the right to change these terms and conditions at any time by amending this page of the Site. Some of the provisions contained in these terms and conditions may also be superseded by provisions or notices published elsewhere on the Site. It is your responsibility to review these terms and conditions regularly to keep up to date with any changes to them.

  1. Information About Us and Disclaimers

This Site is operated by Hoeside Holiday Apartments.

This Site is subject to regular update and revision. While we attempt to ensure the accuracy and timeliness of all material posted on the Site, we take no responsibility for errors or omissions which are the result of circumstances outside our control, technical causes, or otherwise, nor will we be liable if for any reason our Site is unavailable at any time or for any period. We maintain the right to delete or modify the content, presentation, performance, facilities and availability of all or part of this Site without notice.

We do not guarantee that material on this Site will be free from a distributed denial-of-service attack, viruses, worms, Trojan horses or any other technologically harmful material that may have contaminating or destructive properties. It is your responsibility to take protective steps such as installing virus checking software.

  1. Limitation of Liability

To the full extent permissible by law, Hoeside Holiday Apartments assumes no responsibility or liability for any information published on this Site and further disclaims all liability in respect of such information. To the fullest extent permitted by law, we hereby expressly exclude:

  • all conditions, warranties and other terms which might otherwise be implied by statute or common law;
  • any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Site or in connection with the use, inability to use, or results of the use of our Site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
  • loss of income or revenue;
  • loss of business;
  • loss of data;
  • loss of goodwill;
  • wasted management or office time; and
  • for any other loss or damage of any kind, however, arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded by law. We reserve the right to grant access to this Site at our absolute discretion. Access may be denied by us, for any reason, without notice.

  1. Viruses, hacking and other offences

You must not misuse our Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such breach, your right to use our Site will cease immediately.

This Site contains links to other websites and information on the Internet which may be of interest. These websites and their contents are not endorsed or promoted by us in any way, unless otherwise stated. We have no control over such outside websites and you acknowledge by your use of this Site that Hoeside Holiday Apartments can accept no responsibility for the content of the these external sites and should you choose to use them then you do so at your own risk.

For the avoidance of doubt you expressly agree that you will not create any links from any other website to the whole or any part of our Site, either directly or indirectly, without our express prior written permission.

  1. Intellectual Property

The intellectual property in our Site, and all material published on this Site, unless specifically indicated otherwise, is owned by (or licensed to) Hoeside Holiday Apartments and must not be reproduced in any medium save as provided in terms of this paragraph. You may view the Site and download any part of it to a personal computer so that you can view it for private purposes. None of the material, nor its content, nor any copy of it, may be altered in any way, transmitted to, or distributed to any other party without our express prior written permission in each case.

  1. Data Protection

Hoeside Holiday Apartments are committed to following policies which protect your privacy and comply with current UK Data Protection laws and regulations in respect of personal data. We will only obtain personal data from you for specified and lawful purposes and any personal data which we obtain will be processed fairly and lawfully. In particular:

  1. Data we collect – the data we may collect from you includes your name, address, telephone numbers and email addresses.
  2. Uses of personal data – to process enquiries only.
  3. Security – We take all reasonable steps to protect the confidentiality and security of your personal data.
  4. Accuracy – We take all reasonable steps to keep your personal data accurate and up to date.
  5. Retention of data – We will take all reasonable steps to retain data only for the duration of the purpose for which it was obtained. When requested, we will delete personal data from current operational systems where it is no longer required. However we may need to continue to hold some details about you after your relationship with us has ended, for example for legal and regulatory purposes.
  6. Your rights – We will take all reasonable steps to uphold your rights to protect your personal data, including the right to obtain information on, update or amend any personal data on you which we hold. 
  7. This Site uses third party web traffic analysis which uses cookies, which will be placed on your PC. The information collected is anonymous and is used to improve your experience in using this Site. No personal data is collected. This Site will continue to work if you choose to block cookies in your web browser.

  1. Severability

If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, you agree that the other provisions of these conditions will remain in full force and effect in so far as possible.

  1. Non-waiver

Our failure to exercise any right or remedy under these terms and conditions shall not constitute a waiver thereof, nor shall any waiver of any breach by you constitute a waiver by us of any subsequent breach.

  1. Entire Agreement, jurisdiction and governing law

These terms and conditions constitute the entire agreement between you and Hoeside Holiday Apartments concerning access to and use of the Site. These terms and conditions are governed by the laws of England. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Site, although we retain the right to bring proceedings against you for breach of these terms and conditions in any other relevant country.
